These terms and conditions ("Terms") govern your access to and use of any website, digital product, software, or service offered by IMPERUS ("we," "us," "our"), including but not limited to our websites, our digital courses and guides, and our software products such as Pinoir (collectively, the "Services").

By accessing our website, purchasing a product, creating an account, or otherwise using any of our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Our Services

IMPERUS offers a range of digital products, including but not limited to educational content/courses, digital guides and templates, and software tools (such as Pinoir). Each product may have its own specific description, pricing, and delivery method as stated at the point of purchase. Access to purchased digital products is generally provided immediately/digitally upon successful payment.

2. Payment and Right of Withdrawal (EU Consumers)

All purchases are processed via our payment provider (Stripe). Prices are as stated at checkout.

If you are a consumer located in the European Union, you generally have a 14-day right of withdrawal for online purchases under EU consumer protection law. However, because our products are digital content/digital services delivered immediately upon payment, by completing your purchase and checking the checkbox at checkout you expressly:

(a) request that we begin providing the purchased product/service to you immediately, before the 14-day withdrawal period ends; and (b) acknowledge that, by doing so, you lose your right of withdrawal once the digital content/service has been fully or partially delivered to you.

If you have not yet accessed or downloaded the purchased product in any material way, you may contact us at contact@imperus.store within 14 days of purchase to request a refund at our discretion. Once you have accessed, downloaded, or used the product (including logging into a software product, downloading a file, or accessing course content), no refund will be issued except as required by applicable law.

Where applicable, product-specific refund terms are set out in a separate Refund Policy, which forms part of these Terms.

3. No Warranty / Results Disclaimer

Our Services are provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that any Service will be uninterrupted, error-free, or secure, or that it will produce any specific result, including but not limited to income, sales, follower growth, traffic, or engagement. Any results, testimonials, or case studies shown in our marketing materials are illustrative only, may not be typical, and are not a guarantee of your results. Success depends on many factors outside our control, including your own effort and market conditions.

We do not ensure that the information on our website is correct. We do not warrant its completeness or accuracy, nor do we promise to ensure that the website remains available or that its content is kept up to date.

4. Testimonials

Any testimonials, reviews, or case studies shared on our platforms reflect the individual experiences of specific users and may not be typical. They are not guarantees or promises of the results you will achieve, and your results may vary significantly based on your own effort, market, and circumstances.

5. Limitation of Liability

To the maximum extent permitted by applicable law, IMPERUS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising from or related to your use of (or inability to use) our Services.

Where liability cannot be excluded under applicable law (including mandatory consumer protection law), our total liability to you for any claim arising from these Terms or our Services is limited to the amount you actually paid us for the specific product or service giving rise to the claim.

Nothing in these Terms limits or excludes liability for death, personal injury, fraud, or any other liability that cannot lawfully be limited or excluded.

6. Service Interruptions

We make reasonable efforts to ensure our website, software, and services are available and functioning correctly. However, we are not liable for temporary interruptions, delays, or an inability to deliver our Services due to circumstances beyond our reasonable control, including but not limited to technical failures, third-party platform outages, hosting/infrastructure issues, illness, or force majeure events. Where a paid service is materially affected for an extended period, we will make reasonable efforts to restore access or provide an appropriate remedy at our discretion.

7. Third-Party Services

Some of our Services integrate with or rely on third-party platforms (for example, Pinterest's API within Pinoir, or Stripe for payment processing). We do not control these third-party services and are not responsible for their availability, changes to their terms/APIs, account suspensions, or actions taken by them (including if a third-party platform restricts, disconnects, or suspends your account on their platform). Your use of any third-party platform is subject to that platform's own terms of service.

8. Changes to Our Services and Pricing

We may modify, update, suspend, or discontinue any Service, or change pricing for new purchases, at any time. Where a product is described as "lifetime access," this refers to the operational lifetime of that specific product as reasonably determined by us — it does not guarantee the product will be maintained or supported indefinitely or in perpetuity, including if we cease to offer or operate that product or our business.

Prices for our products and services may be discounted or promoted from time to time at our sole discretion. If you purchase a product at full price and it is later offered at a reduced price, this does not entitle you to a refund, partial refund, credit, or price adjustment of any kind. Discount or coupon codes must be applied at checkout before payment is completed; they cannot be applied retroactively after purchase, and we are not obligated to honor missed, expired, or incorrectly entered codes.

9. Eligibility

By purchasing or accessing any of our Services, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are purchasing on behalf of a company or other entity, you confirm that you are authorized to bind that entity to these Terms.

10. Account Security and Acceptable Use

If a Service requires an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must not:

  • Share, resell, sublicense, or transfer your access to any third party without our permission;

  • Reverse engineer, decompile, scrape, or attempt to extract the source code of any of our software products;

  • Copy, republish, redistribute, or resell any of our digital products, course content, templates, or materials;

  • Use our Services to violate any third-party platform's terms of service, to spam, or to engage in unlawful, fraudulent, or abusive conduct;

  • Attempt to gain unauthorized access to our Services, other users' accounts, or our systems.

We reserve the right to suspend or terminate your access, without refund, if we reasonably believe you have violated these Terms.

11. Intellectual Property / License

Unless otherwise stated, IMPERUS and/or its licensors own all intellectual property rights for all material in our Services, including all software, course content, digital products, templates, designs, and branding. All intellectual property rights are reserved.

Purchasing a product grants you a limited, non-exclusive, non-transferable license to use that product for your own personal or business use, subject to the restrictions in these Terms. You receive no ownership rights in the product itself.

You must not:

  • Copy or republish material from our Services;

  • Sell, rent, or sub-license material from our Services;

  • Reproduce, duplicate, or copy material from our Services;

  • Redistribute content from our Services.

Legal action may be taken against any individual or business found to be unlawfully reproducing, repackaging, reselling, or otherwise misusing our intellectual property.

12. Comments and User Content

Parts of our website or Services may allow you to post content or comments. We do not filter, edit, publish, or review comments before they appear. Comments reflect the views of the person who posted them and not the views of IMPERUS. To the extent permitted by law, IMPERUS is not liable for comments or any damages resulting from their posting or appearance.

We reserve the right to monitor all comments and remove any that we consider inappropriate, offensive, or in breach of these Terms.

By posting a comment, you warrant that:

  • You have the right to post it and hold all necessary licenses/consents to do so;

  • It does not infringe any intellectual property right of any third party;

  • It does not contain defamatory, libelous, offensive, indecent, or unlawful material, or invade anyone's privacy;

  • It will not be used to solicit or promote unrelated business or unlawful activity.

You grant IMPERUS a non-exclusive license to use, reproduce, edit, and authorize others to use, reproduce, and edit your comments in any form or media.

13. Hyperlinking to Our Content

The following organizations may link to our website without prior written approval: government agencies, search engines, news organizations, online directory distributors, and system-wide accredited businesses (excluding soliciting non-profit organizations, charity shopping malls, and charity fundraising groups).

Such organizations may link to our home page or other website content so long as the link (a) is not deceptive, (b) does not falsely imply sponsorship, endorsement, or approval, and (c) fits within the context of the linking party's site.

We may approve other link requests from consumer/business information sources, community sites, charity associations, online directories, internet portals, professional firms, and educational institutions, at our sole discretion, based on factors including whether the link reflects favorably on us and provides reasonable value.

Approved organizations may link to us using our corporate name, the relevant URL, or another description that fits the context of their site. No use of the IMPERUS logo or other artwork is permitted for linking without a separate trademark license agreement.

14. Content Liability and Reservation of Rights

We are not responsible for content that appears on any third-party website linking to us. You agree to protect and defend us against any claims arising from your website. No link on any third-party site should appear that could be interpreted as libelous, obscene, criminal, or that infringes or advocates infringement of any third-party right.

We reserve the right to request removal of any link to our website at any time, and to amend these Terms and our linking policy at any time. If you find a link on our website that is offensive, you may contact us; we will consider (but are not obligated to act on) requests to remove it.

Our websites use cookies to help personalize your experience and for statistical or marketing purposes. Some cookies are required for our websites to function and do not require separate consent — by continuing to use our websites, you agree to our use of such required cookies as described in our Privacy Policy. Accepting required cookies also means accepting third-party cookies that may be used via third-party services integrated into our website (for example, embedded video players).

16. Governing Law

These Terms are governed by the laws of the Republic of Croatia, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Croatia, except where mandatory consumer protection law in your country of residence grants you the right to bring proceedings in your local courts.

We may update these Terms from time to time. Continued use of our Services after changes take effect constitutes acceptance of the revised Terms. Material changes will be communicated where reasonably practicable.
